James personally provides representation on behalf of our clients:
- In appeals before the Environment, Resources and Development Court.
- In Supreme Court appeals.
- In Supreme Court Judicial Review Proceedings.
- Before Council Development Assessment Panels and other public authorities.
James is also engaged by other law firms from time to time to provide representation in the courts for their clients within our specialist fields.
James provides strategic advice to clients who are required to make applications to public bodies such as local Councils, the Development Assessment Commission, the Environment Protection Authority and the Native Vegetation Council.
In addition to his Law Degree, James has obtained the qualification of Master of Environmental Law from the University of Adelaide and has taught the Planning Law course at the University of South Australia for many years. James also conducts a range of training services within his specialist fields.
James has also been appointed by the Governor as a member of the Architectural Practice Board of South Australia.
James has extensive experience acting for a wide range of individuals, businesses and industries, small and large, in relation to their interaction with the South Australian planning and environmental legal system. This has included, for example, acting for clients in sectors such as property development, building, manufacturing, retail, waste management and recycling, farming, aquaculture, entertainment and hospitality, aged care and retirement living, health consulting and personal services, tourism and accommodation and advertising. James has assisted his clients to obtain approvals and licences, object to developments, defend enforcement action and oppose the heritage listing of land and buildings.
James is able to draw on his significant experience as an advocate before the Courts when providing advice at all levels. This experience assists James to identify issues, and more importantly strategic solutions, quickly and effectively.
James is able to provide advice and representation in relation to the full range of issues which can arise in the South Australian planning and environmental system including, in relation to matters involving:
- Development assessment
- Heritage listing
- Native Vegetation Clearance
- Environmental authorisations and works approvals under the Environment Protection Act
- Coastal land
- External impacts such as noise, odour, spray drift, dust emissions, traffic and the like
- Enforcement and Prosecutions
- Development Plan policy and amendments
